 1.⁠ ⁠Scope

These Terms of Service govern all orders placed via the website www.noiresoiree.com and apply to the purchase and use of products offered by NOIRE SOIREE, LDA. By accessing our website, placing an order, or otherwise interacting with our services, you agree to be bound by these Terms.

These Terms apply exclusively to consumers within the European Union. Business customers and individuals residing outside the EU may be subject to separate contractual terms.


 2.⁠ ⁠Products and Availability

We offer physical goods, specifically limited-edition conversation card decks. All products are available only while supplies last. A product becomes reserved for you only once your order has been confirmed.

All descriptions, images, and specifications are provided for informational purposes. Minor deviations in packaging, materials, or color may occur due to manufacturing tolerances or screen displays. These variations do not constitute a defect.


 3.⁠ ⁠Orders and Contract Formation

By submitting an order on our website, you make a legally binding offer to purchase the selected product. A purchase contract is only concluded once we confirm your order by email. This confirmation constitutes acceptance of your offer.

We reserve the right to reject or cancel orders at our discretion, particularly in cases of suspected fraud, pricing errors, delivery issues, or stock limitations. If an order is cancelled after payment has been received, we will issue a full refund without delay.


 4.⁠ ⁠Prices and Payment

All prices are listed in euros and include applicable VAT where required by law. Shipping costs are calculated separately and shown during checkout.

Payment must be made in full before your order can be fulfilled. We accept payments via Shopify Payments, and other secure methods made available at checkout. Payment on delivery or installment plans are not offered.


 5.⁠ ⁠Shipping and Delivery

All orders are fulfilled and shipped from our distribution partner in Germany. This ensures fast and reliable delivery across the European Union and surrounding regions.

We currently ship to all EU member states, as well as Switzerland. At this time, we do not offer international shipping outside of Europe. Should this change in the future, our policy will be updated accordingly.

Once a parcel has been dispatched, responsibility for transport and delivery lies with the shipping carrier. We are not liable for delays caused by customs processing, carrier disruptions, or force majeure events.

Please note that orders shipped to Switzerland may be subject to additional import duties, taxes, and Swiss VAT, currently at a rate of 7.7 percent. These charges are not included in the product price or shipping fee and are the sole responsibility of the recipient. The local customs authority or the delivery carrier will usually collect these charges upon arrival. We do not offer Delivered Duty Paid (DDP) shipping at this time. We therefore recommend that customers check with their local customs office to understand any applicable costs before placing an order.

Orders are typically processed and dispatched within two to four business days following confirmation of purchase. During periods of high demand or product launches, processing times may be slightly extended. We will always do our best to ensure timely fulfillment and will notify you in case of significant delays.

•⁠  ⁠Switzerland: 3 to 7 business days (customs clearance may cause delays)

Please note: Business days refer to weekdays (Monday to Friday), excluding public holidays.

Shipping fees (calculated at checkout):

•⁠  ⁠EU Extended countries: from €9.95
•⁠  ⁠Free EU shipping: from €80 or €100 order value, depending on region

If a package is returned to us due to an incorrect shipping address, a refusal to accept delivery, or a failure to collect it from a pickup point within the carrier’s timeframe, we reserve the right to deduct both the original shipping fee and any return handling charges from the corresponding refund.

 6.⁠ ⁠Right of Withdrawal and Returns

At NOIRE SOIRÉE, every product is handled with care and shipped with the expectation that it arrives in perfect condition. As a small, independent brand, we aim to offer a clear, fair, and transparent return policy – one that respects both your rights as a customer and the integrity of our limited product runs.

In accordance with Article 16(e) of Directive 2011/83/EU on consumer rights, products that have been unsealed after delivery are excluded from return due to hygiene and product integrity.

Customers within the European Union have the right to return their order within fourteen days of delivery, provided that the product remains sealed in its original plastic shrink wrap and is returned unused and undamaged in secure packaging. Once the protective seal has been opened, removed, or visibly damaged, the product becomes non-refundable. This exception is due to hygiene standards and the nature of our sealed format.

If you wish to return a product, we kindly ask that you contact us at inside@noiresoiree.com within fourteen days of receiving your order. In your message, please include your order number, the delivery date, and clear photographs that show the unopened product in its current condition.

If the return is not the result of an error on our part – such as a damaged item or incorrect delivery – we will deduct a standard handling and logistics fee from your refund. This fee reflects the real cost of return shipping, inspection, and restocking. For returns from Germany, the deduction amounts to ten euros. For returns from other EU countries, fifteen euros will be withheld. This structure allows us to remain fair and operational while maintaining high service standards.

We reserve the right to decline a refund if a returned item arrives in visibly used condition or is damaged due to insufficient packaging during return transport. We therefore recommend that all returns are packaged with care.

If your product arrives damaged or incorrect, please notify us within five days of receiving your order. In this case, we will ask you to provide photographs that clearly show the outer shipping box with label, the sealed product, and the issue in question. Once the situation is confirmed, we will provide a prepaid return label and send a replacement at no additional cost. Should the product no longer be available, we will instead issue a full refund. These steps help us respond quickly and fairly, while ensuring that our quality standards remain high.

If your order was placed as a pre-order, please note the following. Pre-orders are considered binding and non-refundable once confirmed, as they are produced in limited quantities and often made specifically to meet demand. By placing a pre-order, you agree to reserve a product that may not yet be in stock at the time of your purchase. A refund will only be issued if the product is not delivered within the communicated timeframe – allowing for reasonable production or shipping delays – or if the item arrives damaged or incorrect, as outlined above.

We kindly ask you to place a pre-order only if you are confident in your decision. Every reserved unit directly affects our production and logistics planning, and we appreciate your understanding in helping us manage this process responsibly.

For customers ordering from Switzerland or other non-EU European countries, please be aware that your shipment may be subject to local customs duties, VAT, and import handling charges. These fees are not included in our product prices or shipping costs and are the responsibility of the recipient. Local authorities or the delivery carrier will usually collect these charges upon delivery.

We currently do not offer standard returns for orders placed from outside the European Union unless the product arrives damaged or incorrect. In such cases, we ask that you notify us within five days of receiving your order, and include clear photographic documentation. If your claim is approved, we will provide a return label and send a replacement at our expense.

If a shipment is refused at the border, returned due to unpaid duties, or otherwise made undeliverable, we will deduct all associated costs – including outbound and return shipping, customs charges, and handling fees – from any eligible refund. In many cases, orders with a declared value under twenty euros may pass customs without additional duties, but we cannot guarantee this outcome and recommend that you check with your local authorities before placing your order.

At this time, we do not ship outside of Europe. Should this change in the future, this policy will be updated accordingly and made available on our website.

All content published on our website, including but not limited to product designs, images, text, brand elements, and layout, is the intellectual property of NOIRE SOIREE, LDA. No part of this content may be copied, distributed, modified, or reused without our prior written consent.


 8.⁠ ⁠Limitation of Liability

Our liability for damages is limited to cases of intentional misconduct or gross negligence. In cases of slight negligence, we are only liable for breaches of essential contractual obligations, and only for foreseeable damages typical for this type of contract.

We are not liable for indirect or consequential damages, including but not limited to emotional distress, loss of enjoyment, or third-party misuse. This limitation does not affect your statutory consumer rights.


 9.⁠ ⁠Data Protection

All personal data is processed in accordance with the General Data Protection Regulation (GDPR). Details on the types of data we process, legal bases, and your rights as a data subject can be found in our Privacy Policy, available on our website.


10.⁠ ⁠Applicable Law and Jurisdiction

These Terms of Service are governed by the laws of Portugal, excluding its conflict of law provisions. If you are a consumer residing in another EU member state, you also benefit from the mandatory protections afforded to you under the laws of your country of residence.

We are neither obligated nor willing to participate in alternative dispute resolution proceedings before a consumer arbitration board.
